John, I have seen the fliers you had sent out to TWU Locals and posted widely on Local 100 properties by your staff where your closest supporters are claiming that the 2009 Convention elections were rigged by me. I also know that, while your posture is that you are officially "mute" on the subject as reported by the Chief newspaper,  your personal representatives such as Jim Gannon and others have been working the press to echo that story.  

That's on you. Here is my response. 

John as you know, on March 12th, 2010 documents were produced by your administration ("Bursar's Office") which were delivered to the U.S Department of Labor (DOL) by your counsel, Larry Cary, regarding the dues status of Local 100 members who ran for the position of delegates to the TWU 21st Constitutional Convention held in 2009. 

Pursuant to the Local 100 by laws, the Convention elections and the Local 100 Officer elections were held simultaneously in June of 2009. The dues qualification requirements for delegate to the Convention mirrored the requirements for Local 100 representatives and officers - a requirement of one year of continuous good standing prior to the election. 

Put simply, anyone who was ineligible to run for delegate to the convention would also be ineligible to run for office then or hold office at Local 100 now.  

The documents which your administration delivered to the DOL indicted dozens of individuals, at least 41 that I am aware of, as being in bad standing during the period in question. 

Those documents included of one your closest personal advisors, Tony Utano who is currently Vice President of MOW department, and would have been ineligible to run or much less hold that office.  The documents you had sent to the DOL also included Pete Foley, your current Director of Bargaining Unit Protection; Jay Carrasco (Track division); Dominick Spagnola (LES); Derrick Echerrivia and Paul Piazza ( senior Station Division officers); Josh Friedstein (RTO)  all of whom are know as being among your major supporters -- and many others.

  1. I think Roger forgot a few things:

    1. the election committee that let these people get through was put together by him.

    2. the names he mentions are all TBOU people, there are twice as many United Invincible people on that list. Roger doesn't mention it because that was HIS slate.

    3. i always thought something was fishy about those bylaws in 2008 that split the election up into two parts and held back the results until december.
    If you remember, the same election committee who ran that vote to change the bylaws, was the same election committee that let 41 ineligible candidates through, mostly United Invincible people, Guess whose election committee that was?

    4. Hey did I mention now the TWU international has no record of that 2008 bylaw vote?
    Wow this is getting weirder by the minute.

  2. All ineligible (41) officers should be removed immediately. Including the three elevated to posts in the International.

    All tainted Executive Board decisions including removing Financial Secretary Izzy Rivera must be rescinded.

  3. Your solution adds only more questions.
    Then would every vote by the e-board be null and void?
    How would you decide what votes are tainted and what votes are not tainted?
    Didn't Izzy get kicked out in a vote of 39-2 or something?
    Why put him back in if the majority of good standing e-baord people voted him out anyway?
    makes no sense.
    I think this is a mess that is not too easy to clean up.

  4. If the e-board is fraudulent it doesn't matter how anyone voted. Lets look at Izzy. He was booted out by the locals e board and then the decision was upheld by the International e-board both of these ruling bodies have members who did not pay their dues! And they get rid of the only guy who tried to fix it. Izzy.
    You are right it is a mess and it goes all the way up the ranks of the International. There a lot of pain to go around to fix this but you have 41 representative that do not qualify to represent anyone. Are you going to let them negotiate a contract? It's going to be interesting to see what the Fed does to fix it. I truly believe Izzy should be reinstated he was railroaded.

  5. Well the list of 41 Local 100 dues cheats is out and guess who is on it? The man who moderates this blog and who wants to be the next Local 100 President - Charles Ayala. How can a delinquent dues cheat expect to be our union president? When the chips were down for our local and they trusted in their members to help out by paying their dues on time Charles Ayala FAILED to step to the plate and do right by his union. Is this the kind of garbage bag you want as your next president?
